A waiter was bitten by a dog in Orlando -"outback" Good reason not to bring dogs to restaurants.. Could be a customer next

It seems to be up to the dog owner to know if he/she can take the dog they own to places like this. Kind of hard if you have a new dog. I hope that the lawyers and fear do not wreck a good idea of having well behaved pets at restaurants outdoor patios. From what I understand from other posters who travel a lot, dogs at restaurants outside is quite common in Europe and elsewhere. http://chowhound.chow.com/topics/834076

I believe this very issue might have come up in an old thread when Square 1 opened and they were allowing dogs on their outside patio. It is bound to happen. The inevitable law suit will involve both the owner of the dog and the restaurant. Dog owners that bring their dogs to restaurants might be wise to be well insured for this possibility.

It would be interesting to see what kind of case law there is on the issue of premise liability for dog bites at restaurants.

There are some dogs as well as their owners who probably should not be in restaurants. Too bad that the restaurant owners can do little to prevent unruly patrons until they find out just how damaging they can be.

I hope many have gotten the impression from my writings that there are few dogs I have met that I do not like, while I would have a very hard time saying the same of people unless they are dog lovers. Most of these are usually very big hearted people.

Dog biting waiter is not news or unusual. Report back when a waiter bites a dog!

My nieces baby bite me.
But tonight we are all going out for dinner as if nothing happened.

Maybe using canine waiters in cases like this might avoid any legal actions. Or will cats sue employers on the basis of species discrimination?

Ha ha! My niece bit my FIL when she was a toddler, and he bit her back. It worked. Maybe waitresses will get aggressive.

Tal: Plaintiff attorneys here are salivating over this event. You know the dog owner and restaurant are getting sued. You know the worker compensation people want their money back on the WC claim. You know the claims are going to be both physical and psychological i doubt the first bite free is going to apply here?

With enough notoriety many restaurant are going to re-think this issue

There seem to be a dozen or so lawyers just if Florida covering premise dog bite attacks according to a search I just did on Google. So, I am not sure how much notoriety this matter will have. It's a bit pull. I had a neighbor who was at Wal-Mart and came up to a man with a small dog. She tried to pet it and it bit her. Most reasonable people would know better than to pet a dog in certain situations. Guarding its food would be one of these.

I know very gentle pit bulls mixes who come to Doggie Doo Run Run. I still watched them before trying to pet them for the first time. Some of the smaller dogs can be even more testy than pit bulls. I have had two Chihuahua/terrier mixes and both are/were very sweet for the most part but they can still demonstrate that small dog Napoleonic attitude.

Oh please, if your dog can't bite the help who can they bite? Whenever any of my pack mauls a waiter I leave a generous tip and it's all good.

I would hate to think of waitresses biting my dog. I don't have a dog, so it is most unlikely.

I know you are teasing......and I will add that babies don't have teeth.**** Now, if the infant is beginning to get it's teeth, still and all, a baby's mouth hasn't been anywhere near where a dog's mouth has been. I'll take getting nuzzled by the baby more than getting bit by the strange dog in a restaurant setting.

I was born with a tooth. Had it pulled at age three days old because my mother was having trouble nursing me. I don't remember the dentist visit, but I am sure I stole a magazine.

Personally I think folks should leave their dogs at home when they go out to eat at a restaurant----including outside patios. Only Exception being "service dogs".

No matter legal or not---leave them at home out of respect for the waiter and other patrons. Just an opinion from a poster who really likes dogs----well, most of them!

Well, the term "baby" covers a long period of time. My current baby is 35. Fortunately, he doesn't bite. He's given me colds and flu, though, which I have to say my dog has not.

A solution to the problem:
 

I heard that the dog bit the waitress when she went to give it a bowl of water. This problem can be fixed by the restaurant establishing a new policy: The waiters should be instructed not to give anything directly to the dog. Give it to the dog's owner and let the owner give it to the dog.

I have never bitten wait staff, but it's only because my leash is too short. grrrr.
