Over reach or a sign of the times
 

Has anyone else attended a Village Club function to be asked to sign a release, waive, forever discharge, hold harmless, and covenant not to sue activity release form? I am told that everyone who participates must sign one every year. I must have missed this request last year.

For me, this requests comes on top of now having to register with the Feds to fly any RC device over .55 pounds and a new EAA requirement for having a background check to be able to fly Young Eagles. I look at the new rules, regulations, and requirements as a troublesome preview of the future.

I understand that I should look the other way and just sign as requested. Now, about the new requirements for golf carts that I would like to see enacted in the Villages …..

You're always asked in January to sign one so you don't sue the rec center when you hurt yourself over doing an activity.

It has always been around, the disclaimer. "They" cross their t's and dot their i's.


and I think that for awhile a lot of people keep looking for the downside here. It really IS too good to be true. You will see pretty soon that it doesn't have to be changed. At first I thought that I was being taken. Or hoodwinked, or sucked in. But I am a huge fan now.

We did this for the car club meetings, I was not aware it was for ALL clubs.

If the Rec. Dept. wants members to sign the release every year, they should accost the residents themselves. not ask the club leaders to hassle them. It's not the club's responsibility to do the legal department's job. Clubs have too much to do renewing memberships in January as it is. Besides there is nothing that says you can't use the recreation facilities if you don't sign. In many of the clubs that I belong to, most members refuse to sign it. There is one club that I know of that requires you to sign the release to be a member. I think that's unfair.

By signing it, you give up your rights to blame the district for their negligence.

Nope, this started just a few years ago. There was no release forms about 7 years ago. It was the legal department's afterthought.

I have signed many a release form over the years. Always an option. I can choose not to participate in the activity that requires that I sign a release.

They tell me that one only needs to sign once for all activities in The Villages. The agencies asking for protection are government agencies as presented in the IRS law suit. Maybe the City of Urbana is not as sophisticated as the Villages is in asking for protection from their own citizens. I have never signed anything like this up north in Urbana to go to the parks or participate in Urbana functions.

I believe the release form is for The Recreation Dept. facilities/equipment not for a club. I sign one at the beginning of the year at whatever Recreation Center I go into first and that one release is good for all for the year.

???????????????? Urbana, though lovely, is small. I think it has around 9000 residents now.. You could go to Main Street and holler if you want to tell people something.

That may not be entirely true. As I understand the law, you cannot sign away your right to sue for gross negligence. For example, if management failed to address a safety issue that was brought to their attention then that could be interpreted as gross negligence. Perhaps a attorney can jump in and set us right.

Yes & No For the most part, I ask questions to find answers or solutions when not having fun with the crowd who are great for the most part. :)

I do it three times a year for each softball season. In fact, you can't play softball in TV if you don't, and there are over 2,500 players currently in the softball leagues. This season started in January and we'll play 15 games and again in April and again in September. I haven't signed one to play golf or pickleball.

:wave: When we moved here in 2004 I saw a bumper sticker it said " I DON"T CARE HOW YOU DID IT UP NORTH" Wish I had one of them.

First of all the waivers and hold harmless agreements have been used in The Villages for a long time. So this demand is not new.

Secondly this type of agreement is used nationwide and has been for years and years.

Third while an agency/organization, etc may ask you to sign such an agreement it has been successfully argued that such an entity can not contract its liability away. In some states its the law. For one it circumvents due process and it also creates a moral hazard ie. would result in sloppy maintenance of premises, etc

Knowing all of this doesn't help because if you want to participate you are forced to sign the agreement which in itself may be another arguing point. I now issue my disclaimer as I am not an attorney nor do I desire to try and practice law. For a unqualified opinion call a lawyer

so why does TV bother? Psychology and yes to argue to a court that the injured (plaintiff) understood the risks and agreed to assume them
So depending on the state, the laws, the customs, the judge, the facts of the case, the extent of injuries you could have a myraid of decisions renered by a court

It is interesting that the OP would advocate all types of restrictions and safety measures for golf carts when he was one of the "leaders" against the MMP stripping. What happened to all of the "personal responsibility" he was advocating? :boxing2:

You are correct. The release is for the Rec centers, and one release covers all the facilities. I'm a club leader and this was made very clear to us by the Rec Staff leadership (Pam Henry).

Questions that I can’t find any data, only guesses are as follows:

How many and what type of carts are in use in the Villages?

The percentage of carts being used at night and the age of those users.

A traffic count of cart use on the multi-modal trails to highlight areas of high use.

I could go on and on. How can we and our leaders make accurate judgements on how to do things in the Villages as a whole when we only look to our own personal experience which may or not be the norm? Too many questions are answered by personal assessments. I am sure that the Developers have collected reams of data on us to ensure that they are offering the correct products and the best prices to current and future villagers. Where is the data on golf carts and multi-modal trails in the Villages? Data analysis isn’t everything but it is a good starting point. "

So you sign and I don't. What is the difference? The form signing is haphazard at best. No one checks to see if you signed. I would think that such a random process does not carry much weight.
So what would happen if you went into a rec center and slipped and were injured on a wet floor. Would there be any difference between the form signer and a non form signer?

This seems very logical to me. Why not gather all types of data on any subject? In another thread I asked what everyone thought was the average amount of money spent on food and drinks not prepared at home. A few people answered but not enough to draw any conclusions. My guess was $150/wk. It's a harmless question.

There was a discussion on the number of people who roll through stop signs. Just about everyone said that they didn't. So I went to an intersection with McLin and Hendry and counted 100 cars and carts. 93 rolled through the stop sign when no cars were coming in either direction. I don't think it took a half hour. But the next time I hear that the majority of the people on TOTV don't roll through stops signs, breaking the law, I'll know better

I pull out of my driveway, I live on the corner, and stop my car at the stop sign. That is the reason for the stop sign. I am a first born and a guilt ridden Catholic.

I wasn't thinking as grandly. I just want to buy a couple of clay pots I move from the lanai to the kitchen for some basil and tarragon. [forgive me--i didn't see the fine print--and hope it sound ragey like]
