Small Claims Court
Does anyone have any experience with Small Claims Court here in Florida or any other suggestions for issue resolution. I tried Better Business Bureau but the company never replied to the complaint.
I am stuck here with a beautiful custom made desk without a keyboard drawer and I had someone look at it and they said the way it is constructed it cannot be resolved with a kit. The drawer would need to be rebuilt. |

I took someone to small claims court a number of years ago up north. I do remember that it cost a bit to file so unless it's an issue that involces a lot of money it's not worth doing.
I'm not quite sure by your post exactly what the problem is and who you want to sue. |

As a former property manager in North Carolina I was in small claims court all the time. Every state is different, Even the counties can be different in little ways.
Go online and do a thorough search, You might turn up Some Valuable information. Then go attend several sessions to see how things are handled. in my experience most magistrates Want to be fair And are willing to hear both sides. Good luck and keep us posted. |
I have a very negative opinion of Seniors vs Crime, based on their declining success rates on their annual reports and their seemingly inability to put obviously bad companies out of business in The Villages. For example, on another forum, someone said they had a 6 inch thick file on Service Smart, but the company is still operating. FYI, they are supposed to assist law enforcement to prosecute criminal behavior. Does anyone have a good news story where they have actually helped you?

Yes, Seniors vs Crime helped me get back $354 from a dentist here in The Villages. Very nice people to work with.

I used Small Claims in Florida about 15 years ago over about $800 auto damage caused by an uninsured motorist. The court assigned an arbitrator and I got my money plus court costs.
About 2 years ago, I threatened my former lawn guy with Small Claims over negligent damages to my sliding. It was minor (less than $200) but the lawn guy copped an attitude. Anyway, I did my research and told him he would wind up paying court costs if he didn't fix my damages. He caved. My experience is that I got a judgement, but was unable to collect as the small claims court does not enforce the judgement. So I filed the judgement as a lien against his home. 3 years later when he was selling his house the title company would not clear the title until he agreed to pay me from the proceeds of the sale. I received a check from the title company for my 5000 plus 10% for 3 years. How sweet it is.

Until someone tries to "Get Over" on someone then watch out. The Spoken and Written Word on Policies that Suppliers of Goods Profess actually only apply when you are are on the phone with them. I find that an Eyeball to Eyeball meeting usually solves things in an acceptable way. When they hide behind the phone as some do hide behind a keyboard they don't realize their valued customer has a different Spoken Policy that is better delivered in person. Most problems can be worked out. I do see the value of Small Claims Court and am very interested in learning all I can, Second Hand of Course. |
Small claims court is a waste of time. They don't give you any money. You get a judgement which is almost impossible to collect on if the defendant chooses to ignore it.

So I opened a case with Seniors vs Crime and my parts miraculously appeared but they can't do it this week even though it has now been almost 9 months. Definitely not a priority for them since they already got their money.

So the latest update is that they have agreed to order a completely new desk. Seniors vs Crime was definitely effective in interceding for us.
