GEICO to pay $5,000,000 for insured having sex in car! Will this affect insurance?

Interesting article on insurance coverage! If you thought insurance rates were high, wait until this gets factored into insurance rates! And would this apply to home insurance??

I doubt that it will affect auto or homeowner's rates at all. When I got an auto insurance quote from Geico last year, the maximum liability coverage they would offer was $250K. They wouldn't even sell me a one million dollar policy. So, the only way this guy has $5 million in coverage is if he has a separate umbrella policy, that have different rate structures and risk assessments than regular policies. Most home and auto policies are limited to no more than $1 million in liability coverage and some companies have much lower limits.

Education is wonderful rather jus posting fear.

The other poster is correct..............there are limits & exclusions.
Not sure of any policy that pays during a criminal act.

Also Geico is a $40BILLION company, $5mil is the CEO's annual bonus.

If you have $250,000 coverage and the judgment is for $5 million, the first $250,000 would come from Geico. I read everyday about home insurance rates going up because the homeowner's insurance had to pay $15,000 - $20,000 for a new roof. If paying $15,000 to $20,000 causes your home insurance to go up, I would expect that paying $250,000 would cause rates to go up even more.

You really should delete your post.

It's not paying $20k for a roof that is causing rates to go up.............it's paying for THOUSANDS of new roofs.

If this is the only case in the country, it won't affect our rates. However, I expect that lawyers are looking at this decision and trying to figure out how they can benefit from it.
The Center for Disease Control and Prevention (CDC) estimates that there are approximately 20 million new STD infections each year. If only 5% sue, that would be 1,000,000 lawsuits.

MartinSE 06-09-2022 12:08 PM

I agree the man was liable for knowing and not telling. I disagree that geico was likable.

I was in the insurance adjusting business. I researched the case and GEICO should have to pay it unless there are other courts who could over ride this appelate court decision. This is a much more complicated case than portrayed in the original article.

These stories are designed to grab attention. Reality has little or nothing to do with it.

Thank you, I am not really interested in this, but I am glad to hear you say that. If it really was as simple as the article made it out, it would be incredulous.

This is a classic case of the judicial system run amuck. Is that the only place they had sex? How in the hell could they tell she contracted it in the car?

I was wondering that myself. I would assume that they might have had access to more comfortable venues like his house. But if they had sex at his house, would his home insurance have to pay? Does anyone here work for The Villages’ Insurance?

Stu from NYC 06-09-2022 09:05 PM

What do they have against good old fashioned sex. In a bed.

Cause | Wex | US Law | LII / Legal Information Institute.

The use of the car had nothing to do with this harm unless maybe the marketing of cars as romantic get-aways.

While your source, the London Daily Mail Online, may in this case be accurate, here is what Wikipedia says about that source: “It has also been noted for its unreliability and widely criticised for its printing of sensationalist and inaccurate scare stories of science and medical research and for instances of plagiarism and copyright infringement. In February 2017, editors on the English Wikipedia banned the use of the Daily Mail as a source.” This is the same sensationalizing newspaper that published these lies about The Villages in 2014:
Ten women to every man, a black market in Viagra, and a 'thriving swingers scene': Welcome to The Villages, Florida, where the elderly residents down Sex on the Square cocktail in 'honor' of woman, 68, arrested for public sex with toyboy | Daily Mail Online
The paper sold a lot of papers with those titillating claims at the cost of our reputation. A ratio of ten women here to every man? One phone call could have dispelled that wild myth.

Captainpd 06-10-2022 06:57 AM

Once again, this thread has been stolen by the "roof" thieves. But what the heck, here it goes again. Your insurance rates increase was driven mainly by the increased cost to replace your house. While no one was complaining when their home value increased by 34%, they are quick to blame a rate increase on the roof. If you have any business sense, you can certainly put the pieces together. But just in case, here's a quick example. You hold a policy for my house valued at $400000 at $1500 a year . And said house is now valued at $525000, an increase of approximately 34%. Can you really think that I am going to insure that house for the same amount?? No one complained about the value increase but bitch about the rate increase. It's a business that plays the odds of payouts. The roofs may have played a small part but the replacement cost was/is the driver in the rate increase.

I wonder if the settlement also includes the cleaning of the upholstery.

Thanks for providing. Unless I missed it somewhere, case did not state what happened in the declaratory action. That should be the decision as to whether GEICO owes this award.

If Geico lost or loses declaratory action case, would hope that the legislators change law that allows someone to get an award where in the action taken by the insured/tortfeasor had nothing do with the operation of the car.

This sounds reasonable enough. I don't like insurance of any kind, and insurance that I am required to have to drive my car is aggravating.

However, I understand the reasons it is required.

So, I do think that if I am required to have insurance to protect you from how I operate my car, then it should be limited to the operation of my car, not that I decided to do something in my car that was parked (I hope it was parked - LOL!).

The case was based upon whether the insurance company could appeal an arbitration ruling. Because of steps the insurance company took in denying the claim, it was barred from seeking an appeal.
