Has anyone had experience trying to get a home warranty company to fulfill their obligation? Any recommendations on attorneys?

Before you get a lawyer ($$$$) involved take a close look at the contract many of these have so many out clauses that the coverage is useless. The other option would be to contact Seniors Against Crime and the BBB and file complaints (no cost) and see if this gets their attention. I have seen several reports that these companies can us their own subcontractors and used parts to make repairs, all at their own schedule.

It is likely, virtually assured, that you waived all of your rights to seek legal recourse when you signed your contract by agreeing to binding arbitration. Start by checking your contract.

Their contract is for their protection not yours. Read it carefully before proceeding.

The only thing they are required to do is to fix an appliance in your house. How does it make any sense to hire a lawyer, regardless of how the contract is worded?

try using a small claims court. You'll usually find the defendant doesn't want to spend their time, money and receive bad publicity. You may win your case by spending a paltry filing fee and finding a friendly judge.

Need a detailed fact pattern in order to make a determination. In any event your legal fees would likely offset a recovery.

Look, you made a bad decision buying the policy in the first place. Cut your losses and forget about the attorney, which will cost you more. In the end you could have replaced the appliance, not paid premiums, and probably saved money. Move on!

I had difficulty with my assigned warranty person. My issue went on for months. I then spoke with the manager of the warranty department and it was resolved in a week.

I have an attorney filing against my home warranty company for denying my claim after the technician they sent out dismantled the system. I believe you only waiver your right to an attorney once you file for arbitration. My attorney stated they have many claims against my company in Florida due to their refusal to pay.

Even if there is bindding arbitration, most person(s) are not capable of doing this themselves. Probably more hard to do than going to small claims court.

Agree that this is good route, if contract does not have arbitration requirements. Judges can be very helpful in small claims court

I assume you are speaking of a home warranty you purchased and not the one-year warranty on a newly built Villages home. Some lawyers will take cases where you don't pay unless they win, but those are for very large claims. Morgan and Morgan are the biggest. Small claims court may be worth a try, but if you get a judgment, that does not mean they will pay so good luck on collecting. Contacting the CEO or a manager of the company, Florida Attorney General, BBB, Crimes Against Seniors are all worth a try. Posting a bad review on social media may help resolve the issue, and if it doesn't, at least you get to vent and warn others. I sincerely hope you get a good outcome!
