Does The Villages "Own" Lake Sumter Landing and the Boardwalk?
 
I'm curious- does The Villages "Own" Lake Sumter Landing and the Boardwalk? Or was it built by TV and turned over to some other non-Villages body? I'm asking because there was a story in the local newspaper saying the 'Develper' was unwilling to contribute to repair the boardwalk.

Lake Sumter Landing infrastructure is “owned” by the Sumter Landing CDD (SLCDD). The boardwalk is part of that infrastructure.

AFAIK there are no homes within the SLCDD, there are only commercial properties. The commercial properties are (all?) owned by one of the Developer’s companies.

Being part of the common area, repair of the boardwalk is covered by the project-wide funds under advisement of the PWAC. Essentially, the boardwalk is no different than the Brownwood windmill and water tower which were also repaired with project-wide funds.

EDIT: There is a proposed upgrade to the boardwalk. Part of that proposal, introduced at the PWAC and SLCDD meetings on May 13, was to reclassify the boardwalk as an amenity and move it from the PWAC/PWF to the SLAD.

Yes and no the way I understand it? The developers own lake and land under it and land at squares, but nothing above the land in common areas around lake which includes bridge island under the road way or and eye candy on land at squares like water tower and things that requires expensive recurring maintenance replacement, that’s on use. And there nothing we can do about it so might as worry about something else like homeowners insurance.:ohdear:

I think the issue isn't repair, it's improvements. The boardwalk needs replacing/repair, and that is up to the current government to handle. But the Developer wants to make IMPROVEMENTS - they want it BETTER than just repairing or restoring it to how it was before the flooding. But they're not willing to pay for those improvements.

So really they should just restore it to how it was, and tell the Developer that they're absolutely welcome to come in and improve it, on their own dime, any time they'd like.

It’s hard to find where the idea originated. From a Nov. presentation at the SLCDD, it looks like the boardwalk may be reclassified as an amenity and the entire project done with amenity funds. That was only a proposal so things may change.

No, they don’t own LSL or the boardwalk. But make no mistake, they do have complete control over the entity that does, and they make sure the maintenance cost is absorbed by that entity, which is funded by Villager's amenity fees.

It is actually a rather unusual situation because it is a “tri owned” partnership - owned by developer- 14 people from executive board of tech company and the citizens bank located here in TV. This information is available to view in the internet.

When the Capitalist entity is public you can get in on the profits by buying their stock but that is not the case when it’s private. Back to the OP’s question about the Boardwalk at Sumter Landing…

I suppose a decision could be made to just demolish the Boardwalk and that might (don’t know for sure) be cheaper than building a new Boardwalk. Maybe the Developer would rather put some “skin in the game” rather than have the Boardwalk demolished. Maybe not. I wouldn’t know the legal issues with such a decision as that is above my pay grade. Just a thought.

Just as with the Brownwood windmill and water tower, there is a signed agreement that obligates the PWAC/PWF to repair/replace the boardwalk to its original condition. It cannot just be demolished, it must be replaced. This was made clear by the Developer when a similar idea was discussed regarding the Brownwood structure.

Only you know what you signed. Even if I did, there is not much public common area on my property to be maintained with PWF.
