Tomatoes are a fruit and not a vegetable because they have seeds.
Therefore, shouldn’t Ketchup be called a Smoothie and not a Condiment?

In the United States, Ketchup is a vegetable, per the Supreme Court:

Nix v. Hedden, 149 U.S. 304 (1893) the Supreme Court opined that:

"under U.S. customs regulations, the tomato should be classified as a vegetable rather than a fruit. The Court’s unanimous opinion held that the Tariff Act of 1883 used the ordinary meaning of the words “fruit” and “vegetable,” instead of the technical botanical meaning."

In the dumpster fire known as the EU, the Brussels Mafia reclassified the carrot as a fruit so Portugal could export carrot jelly.

Ketchup should be classified as a lubricant for french fries.

God created tomatoes as fruit. The US deemed them as a vegetable for the purpose of commerce/shipping.

Sort of. It was a question of taxation. There was no import tax on fruit, but there was on vegetables. The Supreme Court ruled that while botanically a fruit, tomatos functioned as a vegetable and were therefore subject to the import tax.
