Landscaping Posts Being Removed

Dear Administrator and Moderator,
Under the First Amendment of the Constitution of the United States you are not legally allowed to remove my posts. My post stating that one of your sponsors, namely KGL Landscaping a/k/a Kevin Gokey Landscaping did my landscaping and caused me so much stress and continues to do so by refusing to file the paperwork for the landscaping he did with the Architectural Review Committee. If you were informed that any of my posts were lies why don't you call me personally and speak to me. I have all the documentation and emails to substantiate what I've written. It is very frustrating to have a vehicle to inform other Village Homeowners which contractors to stay away from only to be told that the only posts that are permitted are positive ones. As a homeowner I would have been delighted to have known to stay away from Kevin Gokey's company had I read a post advising me to do so.

I'm thinking if this was my forum, I could do whatever I wanted to.

First Amendment rights don't apply to privately owned message boards any more than do in your own home. Your rights end when on private property and this message board is private property. We're all guests here and must abide by the rules of the host. Sorry.

They can do what they please unless it's against the law!

It's not against the law to remove any posts here. This is a privately owned forum and they have the right to do what they want.

I am not a lawyer but I'm pretty certain you're wrong. What you're saying is that as long as something is "PRIVATE" the laws do not apply to them. That's like smoking crack in your home and because you own the home you can do whatever you want. Me thinks not! If someone alerts the police that homeowner gets arrested.

That's a horrible thought. That is called bullying.

Any forum or website can by law remove any post in accordance with their terms of service. Our protocols are in accordance within the law and vetted by council specializing in internet law.

We allow any user with more than 10 post to comment (positive or negative) regarding a business or service. When a user continues to post on the same experience it takes away from the 'discussions of TOTV' and the site becomes their personal venue to deal with their situation. When this happens we will remove the excessive posts and ask the user to take the issue offline for resolution with other resources that can intervene to assist them further.

We hope this addresses questions in this post.

Best Regards,

TOTV Team
