Delayed Closing...
 

Supposedly it rarely happens, but, has anyone ever had their new home closing delayed/postponed by The Villages? If so, what problems did you encounter? What was going to be a fairly easy move for us has now turned into a nightmare and packing frenzy because everything will need to go into storage. We happened to be here in TV (from PA) for a few days of R&R when we got the call. This turned out to be a working vacation! We are well aware of what our contract reads, but we have issues that are not covered in the contract. Certainly we want our new home do be properly finished, but we want to be treated fairly as well.

From what I have heard, it never has happened.

What exactly do you want?

If I am not mistaking,

when buying a new build you must close 30 days out or pay if I remember correctly $500 a day, everyday you don't close after the 30 days.

So......if this same rule is reversed.....? You should be compensated for your storage, housing....ect...

only fair...right...

From the 1st page of my contract:

[B]In the event closing fails to take place on the designated closing date and such failure is caused by a default by the Seller and closing is deferred by Seller, the Seller shall be responsible to Buyer for the following reasonable expenses to the extent that they are actually incurred by Buyer as a result of such default:

1. Lodging expenses between original closing date and actual closing date;
2. The Cost of the main meal of the day between the original closing date and the actual closing date;
3. Furniture storage.

When we bought our new house the closing date was to be December 21. We delayed until January 10 and paid $30 per day for the delay.

Cost anywhere else in the nation:. $ 0.

Well yes, that part is perfect. The Villages is doing that for us. They have to, it's in the contract. But what about the "double" moving expenses. Here's the real kicker...they are telling us they will only pay for 30% of the move of our items coming out of storage. Really? I don't think so! We didn't ask that they be put in storage. Why should we pay for 70% of the second move? Many of the items we had planned to move on our own w/o boxing them. It is now our responsibility to obtain/purchase more boxes, bubble wrap, tape, etc., not to mention our time doing it all while here on "vacation". The mover we have already contracted with does not provide storage space. Therefore, we must run around looking at rental spaces for our entire household. We also have cars which they are putting in storage for us.
Per the request, we are obtaining estimates, etc to present to TV management. We are not asking for the moon, but we aren't about to pay more to move than previously planned. I simply put this inquiry out here to ascertain info from others that may have had the same problem.

I have never heard of a delay caused by the villages, sort of. We closed with BOA, TV closing dept had computer upgrades, produced our paperwork 21 hours late to our bank. Said it was our fault paperwork was late, charged us $493. Our bank picked up the fee, and TV closing department was very unhappy about that and let us know we should have paid the penalty not the bank. Go figure

30 dollars day BS, should be close to 100 dollars day and that's just for lodging and 1 meal day for two, which with storage fees should be doubled that. Lots of I got y'all, those pages of contracts. Which few really read and understand lawyers jargon.

What I got from the post was...the buyer that mentioned the $30 a day was in fact the party that delayed their own closing, and paid the $30 a day penalty.

if they charge the buyer $500? a day.....then $30 a day just isn't gonna cut it......

hope you had your own title co or attorney representing you....

Kstew, I read Skyking's post that they (the purchasers) delayed the closing until January 10.
And they (the purchasers) were charged $30 per day for the delay.
Not $500 a day.

Our closing was delayed several days in 2014 because TV sent some papers to the wrong place. We were not charged and forgot to ask them for a better deal.

OK, I have read all of the posts in this thread, but I still cannot figure out the problem the OP is complaining about.

Did the OP have a signed contract with The Villages sales office giving a date for closing on a house? Did the sales office unilaterally choose to change that data?
