Correct Huma is not (yet) under investigation, she can do as she pleases.

One problem I think, the computer is in the hands of the FBI

The FBI has not found anyone to filter through the material on the computer that would not be sickened and need to take time off after seeing all of Weiner's photos. It is going to take some time.
