Villager charged with Aggravated Assault Displaying Handgun

He had a verbal altercation with a neighbor over a dog running loose. During the argument he lifted his shirt to display the handgun, several witnesses saw it happen.
Arrested and charged out on $2000 bail.

Just wondering why one would arm themselves when talking to a neighbor about their dog.
So glad I do not a have neighbor like this guy. ( or should I buy a gun, just in case?)

Wow, can only imagine what would have happened if the dog had p -- oh never mind.

I have never had a conversation with anyone carrying a gun.

That I know of.

I am a big supporter of all rights in Constitution but have not lived in a place I needed to carry a gun.

Yet.

Question: say you have a gun permit and you carry the gun in a holster in plain view. If you have a disagreement with someone, that’s ok, right? I am asking because I don’t know the answer. I’m not trying to make a point about anything.

The problem is brandishing a weapon, not having a weapon. Self defense is a constitutional right, but only to be used in situations where your life is threatened, not when your neighbors dog is bothering you.

I recall working a concession stand as a cashier/cook/etc. back in the late 1970s and my boss was talking to a cop just behind the shop while they watched a softball game at Idlewild Park in Reno, Nevada. The cops and/or fire station people sometimes had softball teams.

Anyway, up walks a guy and his orders something and makes some comment about getting change while opening his shirt up. There was a pistol in his waist band. I thought about what he meant about him getting his change so I just gave him his exact change. I did not think anyone would be so stupid as to rob a concession stand with a team of softball players around some of whom were cops. I watched the guy walk off with the exact change I just gave him and asked the cop behind the concession stand if that was an plains clothes cop that inadvertently showed me his pistol. The cop said no, made a call, and the hunt was on for the guy with the pistol in his waist band. I was never contacted by these cops so I assume that they never pressed charges.

As a single man since age 52 I have over the years gotten out and about in the evenings in Southern California and elsewhere several times a week. Within a short period of time I met a (medically from a rotator cuff surgery issue) retired LA County Deputy Sheriff about my age with whom I enjoyed hanging out in nightspots where we were going to meet single women. It was a while before I realized it but he carried. The reason he told me was that if he ran into some ex-con whom he had arrested and put in jail he wanted to be able to protect himself. One night I asked him to show me his hand gun which he very carefully did by barely revealing it to me in his waistband which was always covered by a never tucked in loose hanging Hawaiian or other style sport shirt. Over the course of a couple of years he introduced me to many LEOs out and about. Every single one of them was wearing an untucked loose sport shirt and was carrying for the same reasons my friend was.

So...you just never know!

Your example is a tough one. You cannot brandish a weapon in Florida, however if the weapon was displayed inadvertently, then the person most likely would not be charged for brandishing (if they possessed a concealed carry permit). It is possible that the person you observed had a permit to carry, but may have gotten a warning to be more careful moving forward. I believe you did the right thing to call law enforcement and let them sort it out.
