New Tree Cutting Law
 
A few weeks ago there was a thread talking about a new law in Florida that allows home owners to remove trees without getting permission from a HOA, or in our case ARC.

Today I learned from Candy Dennis the details of the new law. ARC approval is still needed unless you have a report from a certified arborist stating that the tree poses a threat to person or property.

Thought this was good information that everyone should have.

Members of the Amenity Authority Committee learned at their meeting on Wednesday that the new state law that permits home owner removal of trees without local government approval will have limited impact in The Villages. Because of deed restrictions, homeowners in The Villages must file a certified arborist report that supports a valid reason for tree's removal, said Carrie Duckett, the Districts director of resident services and communication. Residents in violation would be required to replace the tree. Other wise, residents must file and application for tree removal with the District's Architectural Review Committee.(Full report in Thursday August 8, 2019 Daily Sun Section C.Page C-4).

Doesn't apply to Palm Trees though as they are not considered a tree anymore they're considered a grass. At least that's what the letter I got states dated 1/18/2019.

That is also my understanding. Palm trees also do not count as a valid replacement shade tree when a shade tree is removed.

Doesn't state law supersede local laws?
