Anonymous Complaints Senate Bill 60
 

I hear a lot about anonymous complaints - people who file violations about everything - so I thought this would be interesting. This bill was recently signed.
And I am pretty sure the CDD’s fall under this.

“prohibiting code inspectors from initiating enforcement proceedings for potential violations of codes and ordinances by way of anonymous complaints”
Complaint needs to include name, etc - that is can be FOIAd

Nope, no impact on CDDs. It is very specific about being designated by the BOCC and code violations. CDDs deal with deed restrictions violations, and community standards is empowered by the CDD not the Sumter County BOCC.

What was the impetus for that piece of legislation? Who pushed it and why. This certainly will make it more likely we will have shoddy construction with code violations going undetected. Imagine you are employed by a construction company in this fire at will state and you see that your employer or another contractor is cutting corners. Now you certainly will not notify the authorities of that defective construction as it will cost you your job. This is bad law. Whistle-blowers need to be protected to protect the public.

Also, FOIA (Freedom of Information Act) only applies to Federal agencies. The Act has no bearing on state or local authorities at all.

Maybe FOIA wasn’t technically correct - what is it - is it The Florida Sunshine Laws?

Community Standards is the complainant. Their employee verifies the anonymous tip, then files the complaint.

State sunshine laws are the laws in each state that govern public access to governmental records. These laws are sometimes known as open records laws or public records laws, and are also collectively referred to as FOIA laws, after the federal Freedom of Information Act.

I used to request documents from States all the time. Each State has their own process.

I wouldn't worry, about it. When was the last time you heard of a law that protected your right to do what you want with your property, over the rights of an anonymous mob to tell you what you can't do with it? The gooberment always protects snitches unless they're snitching on the government. This bill has as much chance of passing as a politician missing a chance to pick your pocket.

Someone else might point out that those anonymous snitches are simply reminding you of what you agreed to when you purchased your property.
