Fountain and Deed Restrictions
 
Our house has a 5 foot 40 inch high wall in the front of it. It’s my understanding that we can decorate as we see fit between the wall and the front door. The area is not covered by roof much. My question has to do with the front of this short wall that can be seen from the road. Is it permitted to place a decretive fountain in front of the wall? We would like to decorate that area as well. Is there la 2 foot space past the completed wall that is ours to do with as we wish or do we have to leave it as it is?

You are asking the wrong people. You need to read your deed restriction document and ask the ARC (architectural review committee).

In addition to the deed restrictions document there will be an ARC manual for your district.

Go to the Residential Districts page
Select your district
Scroll down to the Architectural Review section
Find the link to the ARC manual for your district

* The manual may be different for each district
* The manual may specifically mention fountains

File an ARC request to avoid any issues. Takes about a week for it to go before the board for an official answer. Otherwise, someone can complain a year later and if not approved per deed, it will have to be removed along with any other changes.

Absolutely agree with above, no cost to fill out the ARC form, and if approved you are good to go, if denied, you dodged a bullet.

In general, in all of our CDD rules. You can have a fountain but not
a bird bath. Still water is a breeding ground for mosquitoes

At first I was thinking a Garden Villa, the height fits, but there is wrought iron along with concrete posts/wall. Corner lots with pool the concrete/wrought iron fence connects with front corner of the house.

The Gardenia and Aspen can have small walls in front of them. I don’t think they build them anymore?

We had a Gardenia, built in 2011. I haven't seen a house anywhere in TV with a wall in front of it, streetside or corner.. I wish the OP would provide a picture along with location.

Whatever you do get the approval documented from your Architectural Review Board, otherwise you're subjecting yourself to a lot of hassle.

Seen Homes
 
We have seen several homes south of 44 with those walls but I’m not sure what type of designer model they are. The non starter for us was the light that goes on the end of the wall. I would think a fountain is OK, but what about the maintenance? The simpler the better.

Actually not true. A friend has a patio villa and his CDD rules specifically allow a bird bath and without ARC approval. Surprised me! Which is why everyone needs to be sure to read the ARC manual for their CDD and they type of house. As there are definitely different rules for a PV vs CYV vs designer home.
