While there are many reasons why a probate estate may be opened, the most common reason is that there are assets that were titled in the decedents individual name at the time of the decedent’s death that need to be transferred to beneficiaries. Assets that are jointly titled, titled in the name of a trust, or for which beneficiaries are otherwise dedicated pass outside of probate.
