Property easements...
 
Okay, help me out here...

Per the neighborhood restrictions it states that the rear easement is 7 1/2 feet, side easement is 5 feet and front easement is 10 feet. However, the lot map for my house shows the easements around the house with a dotted line and the rear easement is at 10 feet, sides at 5 feet and front at 20 feet.

Which is correct? I had contractors tell me we can go to 7 1/2 feet. I am assuming they are correct and if not, my project will not be approved by the ARC.

Anyone else confused here or experience this?

U didn't say what kind of contractors?????

You can extend 2.5' into your easement with for instance a patio slab, but you can not have any structure on that 2.5'.

That's the way it was explained by the ARC to me.

Bring your site plan up there tell them what you intend to do and talk to them, they R very helpful.

That way you won't be removing something later.

Usually stated easements are minimums. Your specific lot may have been large enough to allow greater distance. Easements are in place to allow maintenance of drainage and/or utility lines, or for some sort of emergency access.

We are having a bird cage constructed, initially to the 10 foot easement but now to the 7 1/2 foot easement. The 6" cement footing to support the bird cage will be along the easement. Still not sure what is right....? We will be in TV on Saturday and hope to sort this out.

The cage frame can't be in that 7.5' setback only a slab or footing.

U should see ARC befrore building, U do know you need stamped plans from an architect if you're adding more than 200 sq'

I hope these requirements are being taken care of by the contractor. I wil be glad when it is all over and we are settled in...come on August!

I would get a set of approved plans in my hands before U have work start or pay him.

If it not approved correctly guess who pays?????

Two approvals R needed, the ARC & building dept (they will require an engineers stamp for structures as in ability to withstand wind in a hurricane etc.

A simple call or better yet visit to the ARC is best, they were very helpful.

Well it is official...the ARC approved our birdcage design and it is set back at the 7 1/2' easement. The permit is approved and construction starts any day now. Our lot is 122' long... Not sure if that has anything to do with it or not? The birdcage footing will run along the easement to the concrete patio and support the birdcage, all 48' of it. The dogs are gonna love it!:pepper2:
