MiniMom: First the mechanical. My Club Car did the same thing and the repair guy could not get it to do what was happening to me and so we tried various things. finally afer about the 5th time in his shop he drove the cart all over TV and finally it quit. The result was the motor was overheating and my controller shut it down but for some reason it never picked the event. Once the motor was replaced it runs like a top.
As to the legal aspects. There has to be laws on the books to protect you especially since this is a recent purchased. I would not waste my time with BBB because all they do is record the complaint and for that stated purpose your better to complain to Senior v Crimes.
I would writ them a letter explaining that unless they acted upon your demands immediately you would file a small claims action
If this were me i would have lost confidence in this company and would not accept credit toward another cart (i.e trust has been breached)
I ran into a shady golf cart dealer and wished I had acted sooner. Needless to say his bad dealings put him out of business and I am told one customer put him down on the floor. I wouldn't advise the later action or he might be suing you Best ofluck and so sorry you are having difficulty
