Help setting up an HOA
 

We live in a small CYV neighborhood in District 1, so the developer has turned over various functions to us. In preparation for our annual meeting, we had a few questions about organizational issues and called the district. We were told that we should have an HOA lawyer who would set our organization up correctly. Well, long story short, we can't afford that.

Has any other HOA hired a lawyer? Does anyone have any experience or words of wisdom? Can you point us in the direction of information to help us?

Why do you need an HOA ? I thought the CDD covered all the issues within the district.

Unfortunately not. For one thing, we must assess all homeowners a yearly fee that goes to painting and repairing our outside wall. And that is just the start. Eventually all these things will be turned over to the home owners in all the districts. We are in District 1 so we are the guinea pigs.

May I assume that's just for the villas ?

Different Districts will apparently have different requirements. In my District 8 villa neighborhood’s Declaration of Covenants, Restrictions and Conditions, it states that the District is responsible for maintaining the top and outside walls of villa neighborhoods. I looked up the Covenants document for one of the villa neighborhoods in District 1 and there is language in there about forming a HOA and the HOA’s responsibility for maintenance of the walls.

Your neighbors in Villa De La Mesa have had a homeowners association for years to maintain the pool and other common elements. Could someone direct you to the person who is running it now? Even though it was set up years ago, perhaps the lawyer's name is on the documents. Just a thought.

Anyone know who is the head of their HOA? I do know they pay an extra $45/mo amenity fee for their pool, or at least that is what it used to be. I always thought TV or now the district did that though. I suppose we could knock on doors to scope it out.
