Old deed restrictions

Not really true. Once there is a restriction on your deed, you can't remove it unless there is an "escape clause". The only restrictions that can be "overruled" are the ones that are found to be "unconstitutional". Up north I studied my covenants and low and behold I found a 1850s clause that prohibited my land from being occupied by "a person of color". Clearly, today that would be thrown out but every time the property was sold, that clause went with the property. Ironically, guess who I sold my house to? I didn't have the heart to tell him what was in the big "abstract". Hope he never reads it, like I did. It's also the way I found out my land was once a blueberry farm! :oops: Skip |
