Unless the intended recipient ignores the notice of intent to deliver... then you have proof only that the recipient did not receive the letter.

I would sure love to live next to the “uninformed” citizenry in The Villages. So many have stated just leave it and enjoy the landscaping encroaching on the op’s property. In Florida, squatters develop rights to property/land if owners don’t take action to remove them. I’d hire an attorney if the neighbor is encroaching and refuses to repair encroachment and would also sue for recovery of attorney fees.

Get a survey!!! When I was first living here, my neighbor informed me that my sprinklers were installed on his property. I contacted our builder and he came with a rod that he kept poking in the ground until he found the property line marker. It turned out that my neighbor and I both assumed that the property line was in the middle between the two homes. Wrong, my neighbor had them expand his home when he built and they expanded only on one side toward my home. He then went out further with curbing toward my home. The builder said that he had less than 6 inches to the property line. If you are assuming that the property line is exactly even between your homes, you could be wrong. The builder told me that I could legally have that curbing removed. Most of that grass between our homes is mine, but he mows it anyway. not just his 6 inches. I was not about to have him remove the curbing because I have very nice neighbors who have helped me out on more than one occasion. Great neighbors!

I have my survey, and it couldn’t be more clear that her hard scape is on my property. She lied in the hearing and brought her landscaper to lie with her. This is a case of a dereliction. Of duty on the part of ARC, plain and simple.

I would first get a copy of your survey. If, you do not have it, it is easy enough to get a duplicate. I would try to set up an appointment with the ARC. Phone is easy. A letter return receipt takes more time and costs a few bucks but it is legal proof.

Very safe advice, and honestly my thoughts as well. If TV won’t enforce their own deed restrictions and put ARC on notice about this inappropriate situation , hiring a lawyer and removing the hard scaping will be my next step

This is not just landscape - it is hard scaping that I have to walk around to mow my own lawn. If something isn’t done, my next door narcissist will eventually have right to my property.

If you locate the property line pull a string from front to back tightly. Get a can of orange marking spray paint and spray inside the string on your side. Post us a picture of that. Take that picture to the proper authorities :boom:
