While Obama probably should have, he would have then been viciously attacked...as trying to manipulate the election.
Comey's action one week before the election, albeit possibly benign in intent...had exactly that effect.
By Obama taking the high road however...America is certainly now traveling the low road. :ohdear:

So Obama took the high road?
SO, if Obama saw a law or treason being perpetrated and did not report it, then he would have-IS an accessory to or after the fact. Obama has therefore committed a crime. If Obama spied on an American, then he broke the law if he used the NSA or the CIA. Only the FBI may "spy" on Americans. Intelligence agencies are restricted by law from spying in America or on Americans.
So, either the information that Obama had on Trump was illegally obtained and non-criminal or illegally obtained criminal which makes Obama culpable in the crime. Either way, Obama may be involved in criminal activity. But, Trump may NOT be involved in anything criminal. No one knows until the information is revealed. IF it can be revealed. The information may be classified and not releasable to the public.
It really doesn't matter because Hillary got away with committing felonies and no one cares in D.C. I imagine that fair play means that if anything untoward involving Trump or his team is found, then he should receive the same professional courtesy. A complete pass like Hillary received for all her felonies. All of them worse than anything Trump could have been involved in BEFORE he was in office.
