It could be that the amenities are now well maintained because of the success of the lawsuit. The mold cited in the article doesn't sound like particularly good maintenance to me.

As far as I can perceive the developer didn't have his hands in any cookie jar. Everything was well maintained as far as I could see. And continues to be.
