I wish he could make a recess appointment. But unfortunately, the law requires Senate confirmation. And we know the Senate will not confirm anyone he nominates, no matter how good a candidate he or she is. Their modus operandi is
to block everything Obama does, whether or not it is good for the country. An interesting outcome of this expected prolonged confirmation process, is that the cases on the docket for the Supreme Court will be subject to 4-4 ties. That means an Obama victory for the cases involving unions, The Affordable Health Care Act and contraceptives, and electoral districts.
