The SCOTUS typically only looks at cases that might be overturned to begin with. 
And we don't even know yet...whether the SCOTUS will even take this case.
The fact that The Supremes only took .15% of the Ninth Circuits rulings to look at, means that 99.85% of the Ninth Circuit cases...they didn't think were worth reviewing (potential reversals).
