If you purchase a gun from a federally licensed gun dealer(to be a dealer in firearms your are required by federal law to have a federal license) you are required under federal law to undergo a background investigation. If it comes back denied the dealer cannot legally sell the gun to you. In many states and Florida is one of them, a face to face sale between a private citizens is legal without a background investigation. The majority of private sellers now ask to see identification and a license to carry a firearm before they will sell the firearm.
Numerous studies have shown that criminals get guns by theft, from a family member or through a straw purchaser. A straw purchaser is a person who can legally buy a gun that purchases one in their name and gives it to the criminal. Usually the criminal is prohibited from owning firearms due to previous felony convictions.
