I think the issue isn't repair, it's improvements. The boardwalk needs replacing/repair, and that is up to the current government to handle. But the Developer wants to make IMPROVEMENTS - they want it BETTER than just repairing or restoring it to how it was before the flooding. But they're not willing to pay for those improvements.
So really they should just restore it to how it was, and tell the Developer that they're absolutely welcome to come in and improve it, on their own dime, any time they'd like.
