Technically speaking, if you record the illegal content then you can be held civilly liable.

I vaguely recall one story that came out in some investigative journalism about this topic a few years ago. It involved someone who /was/ prosecuted for copying illegal content from a "grey area" provider of illegal content (aka Warez). Anyone who owns the copyright to content OR gets paid residuals when content is used (actors, directors, etc) - has the right to press charges when they discover someone is using it without them getting their percentage for the work THEY created.
And - there absolutely have been customers of some of these shady businesses that have been cut off from their service, with zero recourse even after they've paid for a year of service in advance (that was a thing for awhile).
