A contractor using illegal labor has a cap of 10 before fines of 10,000 per worker come into play. A contractor would be liable UNLESS they REGULARLY work for another for more than 30 days. If they are subcontracted by a larger entity, that entity assumes associated fines etc. actual prosecution would be determined by worker and their hours. Does the worker work 40 or more hours per week, is healthcare provided for…yada, yada, yada
Immigrants themselves of course could face SB 1036, 1451 and 1589 just under Florida laws. The outcome for them seems more harsh than for the employers.

Any employer who doesn't withhold the payroll taxes for any employee is violating the IRS, Social Security, and Department of Labor laws. These are Federal laws that have nothing to do with the the state of Florida. There is no 10 employee cap for these Federal laws.
