"I don't want to buy a fence with a house attached. I want to buy a home, and I want to know that IF I want a fence between my backyard and your back yard, I am allowed."
If you feel strongly about this you might consider looking somewhere else. I doubt this will ever change. Most people use landscaping in lieu of fences and it looks lovely.
