Thrown out of Villages Recreation?

On Dec. 10, Hendricks was informed by letter by the Villages Recreation Department that he was banned from all facilities. He lives in the Del Mar...

Just read this in the on line....How can you not be allowed to enjoy the recreations in a community you pay for????

That doesn't seem fair....Wonder what he did so wrong....?

does he still have to pay the amenity fees...

Don't you enjoy posts that give you just half the story, especially when they start the thread. I looked at the online newspaper, they have it. I can't post a link, so here it is. They have his photo also, which you can't post here because of the address.

Villager with history of erratic behavior taken into custody on trespassing charge

A Village of Del Mar man who remains banned from all Villages recreation centers and Town of Lady Lake properties has been jailed on a trespassing charge.

Richard Neil Hendricks, 79, who lives at 1209 Maria Court, was taken into custody Friday morning by Lady Lake police. He was booked at the Lake County Jail.

On Dec. 10, Hendricks was informed by letter by the Villages Recreation Department that he was banned from all facilities. He was arrested at a Chula Vista Recreation Center on Friday.

In 2010, the Lady Lake Commission took steps to have Hendricks classified as a “vexatious litigant” because he was filing so many lawsuits against the town. By that time he had already been barred from all town facilities after an incident involving a knife at Lady Lake Public Library.

He has a serious of arrests for trespassing, failure to appear in court, and violation of probation.

Hendricks had recently sought to have Lady Lake end its ban on his presence at town facilities. Commissioners unanimously agreed to keep the ban in place.

Here's another part of the story.

A 79-year-old Villager was arrested Sunday at the Orange Blossom Hills Country Club swimming pool.

Richard Neil Hendricks, 79, of the Village of Del Mar was in the swimming pool at 11:15 a.m. Sunday and the manager of the country club had repeatedly asked him to leave. Hendricks, who reportedly ignored the manager, has been banned from the pool.

Lady Lake police arrived on the scene and arrested Hendricks on a charge of trespassing. He was booked at the Lake County Jail and released after posting $1,000 bond.

Hendricks had been arrested in March when he showed up at the Chula Vista Recreation Center. You can read about that arrest HERE

I think it would be worth the $145 per month to the Villages Recreation Department not to have him around.
Seems as though some people just do not want to be happy.

Bonny 07-18-2016 05:25 PM

Just saw him last Thursday by City Fire.

What is the purpose of this post? Seems clear it has very little to do with the facts.......

Yepper, I agree ! :D

pauld315 07-18-2016 10:57 PM

I still don't see exactly what he did to get banned. What exactly did he do?

If he has been barred from all recreational amenities he may well be able to claim a waiver of the $145.00 per month fee. Perhaps that is one of his court claims?
And without knowledge of the petitions made in his lawsuits I cannot judgment comment

I don;t believe that people want to be unhappy but rather they do not know how to be happy. Perhaps if not a medical condition, then perhaps whatever tragedy(s) that came into his life he has not been able to properly process it. He appears to be in a lot of mental pain. He needs professional help and I say that with great empathy for this guy. I pray there is someone in his life looking out for him. Having said that its clear people should not have to carry his burdens or be subjected to his rants, etc

For most of us life is sorrow so we understand that when joy enters our life we grab hold of it quickly and hold it as long as we can

Somewhere I read that Lady Lake are banning him for "litigious behaviour" - whatever than means!

gomoho 07-19-2016 06:35 AM

This unfortunate man appears to have some mental health issues. He needs help - not criticism. And if God forbid he gets his hands on a gun everyone will be scratching their heads and wondering what went wrong.

The legal term is.... "vexatious litigant."

Vexatious litigant legal definition of vexatious litigant

Quote:

vexatious litigant: a person who brings actions with no reasonable chance of success with the object of causing annoyance to opponents; such actions maybe struck out, and the court may order, on application of the ATTORNEY GENERAL, that no further legal proceedings may be begun by the vexatious litigant without the leave of the court.

A similar procedure has existed in Scotland at least since the Vexatious Actions (Scotland) Act 1898 whereby the LORD ADVOCATE may apply to the Inner House preventing a party raising an action without the permission of a LORD ORDINARY.

I would not want him suing TOTV or me for some reason.

I have met people who just like to sue anyone they disagree with in some manner.

outlaw 07-19-2016 07:20 AM

How can a municipality or the TV recreation center ban someone because they are litigious? One would think that, as a taxpayer/amenities payer, he would have to be compensated for the loss of these amenities. It's not a safety issue. It seems to just be an inconvenience issue. Why not counter sue this guy for legal expenses if his suits are frivolous? What if Lady Lake decides they want to ban him from driving on their roads? Strange.

Bonny 07-19-2016 08:10 AM

If anyone on is on Suzie Casta's facebook, there are some remarks about him on there.

Thanks Bonnie.

When I was a Student Director at Legal Assistance to Minnesota Prisoners I had to deal with some of the jailhouse lawyers at Minnesota Correctional Facility--Stillwater. They had a lot of time on their hands and would try to sue anyone they could just to keep busy and often wanted me to do research for them that would have taken me months to do. My Supervisor would just look at me funny when I tried to do some of this research as they just wrote it off a long time before as a waste of time.

It seems like some of these nuisance lawsuit filers just have too much time on their hands.

After seeing the reason for banning him, would you want him around your family including grand children?. :22yikes:

Was there more than just litigiousness? Not exactly a safety issue or profanity/lewdness.

It's no different than when the state takes away your right to drive a car. You could say, his taxes help build the roads and highways, how can the state take away his right to drive on them. Every right of use has rules or laws, break those and you should lose your rights. The Villages is no different, if you can't abide by the same rules as everyone else, then you lose those rights.
