Courtyard Villa 'Alley'
 
Would I be allowed to install one or two of these near my side of the house but in the neighbor's alley?

Their water sprinkler is hitting my house; they are snowbirds and did not seem too keen on the idea.

I hope you get your issue solved. I really don't think you would be out of line making adjustments to the sprinkler heads as they are impacting your villa. Good luck.

I hope it’s not stucco and has cracks? If they cause water damage they will be responsible.

That foot alley is restricted drainage area along you’re house. You’re neighbor can’t have anything touching you’re house or fill in that area with concrete slab or paver blocks, also plants can’t be touching either. File complaint see how keen they are on that idea?

In my opinion, it would not be allowed under the deed restrictions. I would suggest you read the deed restriction document very carefully. There are two sections that describe the "driveway easement" and the "side yard easement". In the case you described, your neighbor is called the "dominant tenant" and has the exclusive right (with certain exceptions) to use the property adjacent to your house, even though you own part of that property. I don't think you have the right to place anything on that part of your property. But, your neighbor should adjust their sprinklers so they don't stain your house. Also, you need to be aware that, if one of those sprinkler heads breaks off, it can create a geyser that can spray water under your eave and flood your house.

And the neighbor would be responsible for damage caused by irrigation system.

Just do this. For the same price you could switch out the head to a 180 or 90 or simply turn it so it doesn't hit your wall. If you do it right, they won't even notice.

The water shouldn't be hitting your wall, so if it is, you don't need to wait until January to fix it. Ultimately I'd get to know them enough that issues like this would never be a problem again. Do your neighbours really want to waste and pay for the water. that is splashing on your house? I would ask them . Also you can re set the top of the sprinklers with a small turn and air them back to their house

How did you know they weren't too keen on your idea?
Easily remedied by the neighbor by adjusting the heads of the sprinklers hitting your house.

It could be that they are using the wrong type of sprinkler head in that location. It is usually a linear strip of plants that requires a special sprinkler head that sprays in two directions, left and right, but doesn't spray toward the exterior wall or toward the sidewalk. ACE Hardware can advise you about what type of head should be used there. If they are using the wrong type, I would take a photo while the system is on and ask the owner to replace the heads with the correct type.

You should suggest this to your neighbors. If they won't do anything, if it were me, I would go ahead and make the adjustments myself!
