I guess if you find a Sugar Momma and are gambling that she'll out-live you, it's possible to get caught on the wrong side of the curve. just an anecdotal observation, but if they lived together for 20 years and the recently deceased didn't do anything (like give him a life estate in the home), she wasn't that concerned about what would happen when she died. |

People in that situation should have a discussion so that the significant other is provided for if the owner dies first.

I tried to help a woman whose live-in boyfriend would not move out. Eventually he became abusive but she had to go through hell and back to get him out of there before that. It seemed he had some rights. And he might have been paying her rent as well. Or part of it.
And another woman had to move out because her boyfriend owned the house where they both had been living, They split up and she had to get out. Both of these situations were in or near the Villages. |
Happened to man a few houses down from us a few years ago. He suddenly died, and his SO was unceremoniously kicked out of the house by his kids. She was so distraught. Nothing to be done.

If a reverse mortgage is involved this not much you can do if you are a surviving kid, significant other, etc. But I am not a Family Law nor Estate Attorney nor licensed in Florida.
Neighbor had to get out when both her parents had died. They had had a reverse mortgage. And the daughter did not have enough money nor the desire to buy the house. She found a place not too far from the Villages though. |
Florida does not recognize common-law marriages that have been established within the state after January 1, 1968. This means that if a couple meets the general conditions for a common-law marriage but has never been ceremonially married, Florida law does not consider them legally married.

Beware of letting someone rent a room in your home. In many states you can't evict the person if they fail to pay their rent without a lot of legal action and even then, it can take months to get them out. I'm not sure about Florida so it would behoove a person to check the local and state laws.

Put all the pertinent facts such as whose name is house in etc. By the way if me is paying tent or not, one must file for an Ejection,
There are also stiff laws regarding exploitation of the elderly as well as mistreatment. |
Being in a long term relationship without marriage and not having any legal agreement between them was obviously not wise. You would think that those who choose a relationship without marriage would want to protect each other well being. A property agreement or drafting wills with respect of each other is not that difficult. On the other hand the relationship may have been very non-committal and in that case each would have no connection to the other's assets. Its sad that many people do not understand the complex legal system that our society imposes.

If the kids try to immediately boot him someone should aid him, ready to dial the police to report elderly abuse. He does have 30 days to vacate even if there is no lease by law in FL. The man needs a lawyer comes to mind if they try to immediately boot him out on day one after death of partner. They have to evict him through court system in FL if he fails to vacate in 30 days. It is against the law to "change the locks" or remove a front door to keep him out. He legally has 30 days. |
