Florida Department of Health Final Order and Emergency Action Search

Above is a link to the 2012 complaint filed against Dr. Dean, who currently practices in the villages at tri-county health and you can view the 2013 department of health charges against him. No criminal charges have been filed.

What is not apparent in that record, is that Dr. Dean was practicing in Lakeland at doctor today, similar to an urgent care center, when he performed a vaginal exam, which is a specialty he is not credentialed for.

One would think so, but he has apparently been able to move, get jobs and stay out of papers for the most part and now the victim gets robbed of justice. He has cut a deal to stay in practice so the articles say.
I do not know what to do to advocate for justice, not to mention preventing further victimization, I'm thinking about it.

OMG !!!!!!!!!!!!!!!!!!!!!!!!!!!!!! This is our Dr.!! We had no idea! I always liked him and thought he was pretty smart and accurate. Forget it now..any suggestions for a new Dr that doesn't have a grey area?

Keep in mind that as far as I have read there has been no independent verification of the charges. Unless other claims pop up, you have to consider that this doctor may have been conned. This could be just all about money!

That's true. He has always been kind and nice to me. NO crossing the line or anything other than professional. I say innocent until proven guilty. Florida is a sue crazy state. Maybe you're right and he was conned.

I definitely would not want to write the guy a free pass on something like this, but I can imagine a scenario where there was mutual "sexting". Then all of a sudden things go south. Girl gets attorney and sues his employer. I would love to see the young woman's texting records.

Regardless of the details, this guy should fire his attorney. NO attorney worth his salt will ever all his client to admit any measure of guilt without a quid pro quo.

A doctor who got into trouble for sexting at work will be called before the Florida Board of Medicine on Friday.

Dr. Tuan Kishfran Imran Dean, a family practitioner in The Villages, was working at a Doctor Today walk-in clinic in Lakeland when he displayed inappropriate conduct in August 2011, according to Department of Health records.

The focus of Dean’s interest was a 29-year-old woman, a Medicaid patient who came to one of the Doctor Today clinics in Lakeland for a prescription refill and a couple of minor ailments. Records do not identify her beyond her initials, E.S.
According to the report filed in December 2012 by DOH investigator Jeanine Shaffer, E.S. said Dean behaved strangely while examining her, including maintaining eye contact while performing a pelvic exam.

That night, she told authorities she received the first of several texts from Dean that to her seemed overly personal. When she questioned whether it was ethical, since he was her doctor, his texts became vulgar, according to the state report.

At one point E.S. went to police to report Dean, but she said they told her it was a civil, not criminal matter. E.S. backed up the texts and additional materials Dean sent to her computer, including a photo and five videos in which Dean is “pleasuring himself,” as the report puts it.
E.S. turned them over to her attorney, Kimberly Hosley of Orlando, who passed them on to Shaffer, the DOH investigator.

The administrative complaint against Dean alleges he engaged in sexual misconduct, an abuse of his professional position. DOH prosecutors and Dean’s attorney, identified in state records as Michael L. Smith of Altamonte Springs, worked out an agreement that would settle the case, if the Board of Medicine accepts it.

In the proposed settlement, Dean neither admits nor denies wrongdoing. But he agrees to accept discipline including a reprimand; a $10,000 fine; participating in courses on rules and ethics; a requirement that a female health professional be in the room whenever Dean sees a female patient; and compliance with the PRN program, which monitors professionals who have harmed themselves or others because of mental illness or addiction. PRN, a contractor, is to blow the whistle if a practitioner breaches the agreement.

The complaint that led to the investigation was filed by Dr. Rekha Issar, who had employed Dean at the Lakeland clinic, after she was contacted by E.S. and attorney Hosley. Dr. Issar told DOH that by the time she heard about the problem, Dean had already moved on to another job, the report shows.
Dean is currently practicing with TriCounty Physicians in The Villages, according to the practice’s website.

Shaffer also spoke with a medical assistant who had worked at the Doctor Today clinic with Dean. The assistant, Brenda Medina, said she never saw Dean display inappropriate behavior, the report says.

A doctor accused of sending sexually explicit videos and texts to a patient should be barred from treating females and should be suspended until he completes a psychiatric evaluation, the Florida Board of Medicine said Friday.

But the board cannot order Dr. Tuan Dean, a family practitioner in The Villages, to comply. He can continue to practice until he receives formal notice of the board’s decision and then can take seven days to reply. If he doesn’t want to accept suspension and a male-only practice, which is likely, he can force the Department of Health to prove its case before an administrative law judge.
DOH prosecutors warned the medical board that may be difficult; they said the patient is not willing to cooperate and testify. But the majority of board members insisted they try.

“The doctor-patient relationship is sacred, and I can’t imagine any higher betrayal,” said Dr. Jorge Lopez of Maitland, a board member. “I don’t feel very comfortable with this individual practicing medicine.”

Dean, who came to the Orlando meeting with an attorney, expressed remorse. “I know I’ve done something really bad,” he said. “I have taken steps to make sure this never ever happens again.”

The alleged incident occurred in August 2011, when Dean was working at a Lakeland walk-in clinic. By the time the patient came forward, however, Dean had moved to a different job. He has been practicing at TriCounty Physicians in The Villages, according to the practice’s website.

In August through early October of 2013, after Dean became aware the state was investigating, he went to an inpatient treatment center in Lawrence, Kansas, the Professional Renewal Center. He was due to return to the center for follow-up in March, but said he could not because of family issues. He said his 2-year-old son is very ill.

Dean told the Board he has been attending therapy sessions and support-group meetings each week, and is limiting his work hours to reduce stress. He said he has signed a five-year contract with Professionals Resource Network (usually called PRN), which contracts with the state to monitor physicians who have been in trouble.

His misbehavior in 2011 was brought on by overwork and stress, he told board members on Friday. “I was working seven days a week,” he said. “I was burned out.”

Three members of the board pushed to accept a settlement that would let Dean continue to practice with PRN monitoring, as long as he always had a female licensed health professional in the room when he saw female patients.
Dr. Zach Zachariah, a board member from Fort Lauderdale, said that would make more sense than offering a settlement with a stiffer penalty, one that Dean is likely to reject. Given how difficult it would be for DOH to mount a case against Dean without the main witness, the state may lose, which would leave the board with no control over the doctor. Even if the state prevails it takes a long time to prosecute.

“It could take a year or two years. If he has a damn good lawyer, it could take five years,” Zachariah said.

But two women members of the board, Dr. Onelia Lage of Miami and consumer member Brigitte Goersch of Satellite Beach, objected. Lage said the board usually goes for revocation of the license – suspension at a minimum — in sexual misconduct cases. Goersch said it just made her “uncomfortable” letting Dean continue to practice without any warning to his patients of what he had done.

The state’s investigative report says Dean focused on a 29-year-old Medicaid patient who had come to a Doctor Today clinic where he worked. The complaint against Dean was actually filed by Dr. Rekha Issar at the Lakeland Clinic after E.S. and Hosley contacted her, records show. Health News Florida was unable to reach either Issar or Hosley.

At this point, it isn't a criminal case. It is only an administrative complaint. If he refuses to accept the disciplinarian action from the medical board, the board would have to take legal action against him. But the part of the story that is missing, to me, is why the won't have a witness if they do this.

Thanks for doing the research, BK.

The August one article says that the medical board rejected the terms offered by Dr. Dean's attorney, and are asking for psychiatric evaluation, as well as termination of his right to see female patients.

I still think the man should face criminal charges for sexual harassment, but at least the medical board is making some sense with their demands.

Having worked with multiple types of sexual abuse perpetrators ever many years, I can tell you that there is no kind of treatment, no matter what this doctor has gotten or will get in the way of treatment, that will fix his urge to push himself on young women. Not even fox urine and plethysmography can help. Nor can castration.

Never in my five visits has the Dr. ever acted inappropriately. He's always been very professional and polite. AND no he never asked to see my vagina. But then I'm a fat middle aged man.
Folks you really need to cool your jets when these stories come out.
Make an appointment with your Dr. if you want to know what is going and and ASK HIM about the reports. Doctors really appreciate when they are treated fairly.
But then again we here in TV have it all figured out. Thank god we don't have our own court system.
