New driving law beware and be aware
This came to me in an e-mail. I knew about the law, but did not know to what extent the police would go. I try to move over if at all possible, but it's not always possible. Be governed accordingly.

Great info! Here's the official quote from the Florida Statutes:
The 2012 Florida Statutes Title XXIII MOTOR VEHICLES Chapter 316 STATE UNIFORM TRAFFIC CONTROL View Entire Chapter 316.126 Operation of vehicles and actions of pedestrians on approach of authorized emergency vehicle.— (1)(a) Upon the immediate approach of an authorized emergency vehicle, while en route to meet an existing emergency, the driver of every other vehicle shall, when such emergency vehicle is giving audible signals by siren, exhaust whistle, or other adequate device, or visible signals by the use of displayed blue or red lights, yield the right-of-way to the emergency vehicle and shall immediately proceed to a position parallel to, and as close as reasonable to the closest edge of the curb of the roadway, clear of any intersection and shall stop and remain in position until the authorized emergency vehicle has passed, unless otherwise directed by any law enforcement officer. (b) When an authorized emergency vehicle making use of any visual signals is parked or a wrecker displaying amber rotating or flashing lights is performing a recovery or loading on the roadside, the driver of every other vehicle, as soon as it is safe: 1. Shall vacate the lane closest to the emergency vehicle or wrecker when driving on an interstate highway or other highway with two or more lanes traveling in the direction of the emergency vehicle or wrecker, except when otherwise directed by a law enforcement officer. If such movement cannot be safely accomplished, the driver shall reduce speed as provided in subparagraph 2. 2. Shall slow to a speed that is 20 miles per hour less than the posted speed limit when the posted speed limit is 25 miles per hour or greater; or travel at 5 miles per hour when the posted speed limit is 20 miles per hour or less, when driving on a two-lane road, except when otherwise directed by a law enforcement officer. |

I've always moved over when I see an emergency vehicle on the side of the road with it's lights flashing. Just seems like the courteous and SAFE thing to do.
The Snopes article says that the maximum fine is $200 and $500 if there is property damage. I guess that is only for Texas.

Move Over Law
The Move Over Law has been in effect for years in most states, but hasn't been enforced. They have begun to realize it is a problem with some many troopers being hit. When it started it was required of Commerical vehicles and then extended to private vehicles. I was a driver for over 15 years and that was always the policy. I retired in 2007. |

hard to debate what just makes sense....as the judge always says, ignorance of the law IS NOT an excuse....discuss OK...excuse NO!

Once you have had to change a tire on the side of the interstate, you learn to move to the left of slow way down for ANYBODY on the side of the road.

Like I said "No big deal',This has been around for years,if you have been driving a car during that time and did not know of it,"Shame on you".Everyone moves over one lane,however you can stay in your lane if it is impossible to move without causing accident and you reduced your speed.

PS, If you do receive a ticket,pay attention to where he marks road conditions,light ,moderate,heavy,traffic, make sure he is aware that conditions made it unable to merge into next lane because of heavy traffic.

Another example of government out of control. Of course you can justify it on safety grounds. I could come up with dozens of good ideas that would improve safety..
but laws must be reasonable and must include common sense. We need fewer laws (these are really just regulation.. heard about too many regs lately?) When will the public finally figure out these are revenue laws and kick out every politician who refuses to eliminate them.. by the way.. NO politician will vote against these laws because they do not want to be accused of being against safety and law enforcement AND they are revenue raisers. |
