Florida Statute 765.202 sets forth the requirements for a Designation of Health Care Surrogate in Florida. The out of state Medical Power of Attorney you are referencing will need to be executed in accordance with the terms of Florida Statute 765.202 to guarantee that it will be valid in Florida. It would be a good idea (especially if your friend has a medical condition) to have your friend execute a Florida Designation of Health Care Surrogate, or at a minimum have their out of state Medical Power of Attorney reviewed by a Florida attorney, to ensure that there would be no issues if your friend were to be admitted into a Florida Hospital. I would be happy to assist. Please give me a call at (352) 365-2262.
