Default Neighbor tree

My first legal question related to villages. If your neighbor has a tree that is closer to your home ex: (near our driveway) it makes a mess all over our yard actually not his, anything we can do?? Actually I think the villages should have planted it closer to his home rather than ours but it is what it is. My hubby is getting tired of leaves all over our driveway?? Any recourse we can take?? Are we allowed to cut branches hanging over our property?? Thanks

Typically you can cut or remove any part of a tree on or above your property. However, I would suggest discussing this issue you with your neighbor prior to cutting the tree. You will also need to review the restrictions or other rules related to your land prior to cutting any trees to make sure you are not prohibited from doing so without prior consent.

What could happen to you if you trimmed an overhanging tree or shrub, without asking the owners permission ?

This is a really open ended question, but your neighbor's main remedy would be to sue you for damages if you failed to properly comply with the law.

What is the law in this case? And how does it apply to the neighbor who does the trimming?
