As long as your trust and will were prepared legally and properly in the State you had them created in, they are valid in Florida. Florida recognizes all other States legal trusts and wills as long as they were properly prepared in the State of origin. Google it and there are multiple postings affirming this to be the case. I'm not sure if Florida attorney's will tell you this unless you specifically ask. On the other hand, is it time to update your end of life documents?

Default Amend Wills

Can understand confusion over amending wills, POAs but each state has their own laws regarding what must be in these documents. We had just had our wills done in NM in 2020 & had them reviewed by Katharine Linn and there were a number of changes necessary. Since Florida is our primary staye of residence, these docs must be in accordance to FL law.
It really helped us understand the changes needed by attending one of Ms. Linn's briefings about wills, trusts etc. I'd highly recommend attending a presentation first before hiring anyone, so you have the facts.

A Lady Bird deed, or enhanced life estate deed, allows property to pass automatically to one or more designated recipients at death without the need for Florida probate.

We actually sought bids from recommended law firms to update our wills, and create a family trust, along with the requisite powers of attorney. This stuff is not rocket science, but still needs to be handled by a competent attorney. We wound up using the Millhorn & Shanawany Law firm for our documents. "Sham" Shanawany is a great guy, and did all of our work for less than 1/3 of what the Pittman Firm wanted for the same service. Shop a little, save a lot.

I'll second that with Ed. Switch to a trust. Avoid the long probate process. Much easier on your loved ones. Everything is private. His fee was reasonable.

If you want to make it as easy as possible for the survivor have your wills prepared by a Florida attorney if that is where you declare your residence. I understand Trusts are not as important. You can avoid expensive probate by having a will yhat complies with Florida law. Also there are apparently advantages to having a FL Will when living in Florida.

Talk to a Florida attorney, not the internet. I have been very satisfied with McLin Burnsed Attorney (352) 259-5011

Ask the cost of an update of needed in the future.

A one paragraph change cost me 50% of original cost from one of the most recommended attorney's suggested here.

Where are your assets? If you are residents(tough to define) of FL and the bulk of your hard assets are here, then a FL lawyer. If your real assets are in both states, you have too many options to discuss here.
