Legally, you are correct, although the question on the current Form 4473 is No. 21E.

However, a GAO report in 2018 recommended that the ATF start to issue warnings instead of prosecutions. In their report, they said that, in 2017, of the 8.6 million Federal background checks for gun purchases, there were 112,000 denials, and only 12 prosecutions. So, the chances of being prosecuted for violating the Federal marijuana laws is pretty close to zero.

Actually, I think it depends on which state one gets their Medical Card from. Some states elect to share their database of cardholders with the Feds and others don’t. I talked to our towns chief of police about this before I got my medical card because I didn’t want to lose my ability to hunt. The chief of police in my northern town is responsible for processing firearms licenses. He told me not to worry about it, he has a card also, and our state doesn’t share the database with the Feds.

Even if some states share their Marijuana database with the Feds, it appears that the Feds are not using those databases to deny gun purchase applicants on the Federal background check. Only about one percent of applications are denied, and most of those are for felony convictions, documented drug addictions, or errors on the form.

Guess it is up to your risk tolerance. It is illegal to cheat on your taxes, some still do. Federal law trumps state law when it comes to marijuana and firearms.
