Default Closing a 'for sale by owner

Our sister-in-law has found a house to by in TV but it is a for sale by owner. Who should she call to get the sale process done right?

Call Freedom Title Company in Lady Lake. 352=633-5195 Many MLS Realtors rely on them.

McLin-Burnsed located in Lake Sumter Landing. You can go the the lobby, across from Panera and pick up a package. The buyer and seller fill in the info and return it to the Lake Sumter Landing office. McLin Burnsed will write the contract, schedule the closing and have the title search done. They will take care of everything.

Tri County Land Title and Escrow also takes care of everything for you..from contract through closing. 352-753-4411.

We used Tri County. Sue helped us manage a seller who changed his mind about selling right before the closing. She was excellent.
McLin Burnsec charges additional fees. You do not need a lawyer to close on a house n Florida.

It is a quarter of a million dollar business transaction, not a car purchase. A few hundred dollars for an attorney to either prepare or review the purchase agreement is well worth it.

Tri County did the closing for our less than a $250,000 house purchase! Professional and informative! Love that all paperwork was duplicated on a CD for the computer! - so much easier than a bunch of papers - they went to the safe deposit box!

Has a contract already been written and accepted by both parties?
If not, you may want an attorney to write one up.

If the seller is using an attorney, by all means, I would recommend that you have one also.
If there are any unusual details, I would also recommend usuing an attorney.

If the sale is a very ordinary sale with no unusual clauses, a title company can do exactly what an attorney will do and you can save the attorney's fees, but they do not write contracts.

The title insurance amount would be the same no matter who you use. That fee is determined by the amount of the sale.
If the seller can provide a copy of their title insurance (when they originally purchased), there should be a small re-issue credit.

Just as a point of information, the title insurance fee is not set in concrete and is negotiable.
The person who pays this fee is traditional thing in each county.
In one county the buyer may pay it and in a different county the seller may pay.

First she needs to contact the sellers and let them know she wants to buy. Then she prepares the contact and presents it to the sellers. The sellers will be paying the title insurance and the sellers decide who they use for a title company. I am a Realtor with Realty Executives. If she wants help have her PM me. I will not charge a dime just want to make sure they have a correct binding contact, that she is not going to be paying for anything more than she should be and that she is protected. I have seen so many costly mistakes on FSBO sales just because the buyer and seller do not know. It is not the title company's responsibility to review contacts or determine who pays for what. Again I will not charge anything. Just offering to help.

Just sold my mothers house in TV by owner. Used McLin...made sure everything was done properly, did the closing, and wasn't too expensive. Gave everyone peace of mind and it was a smooth and easy transaction.
