Default CYV Question

On the side of the house that the home owner has to access through the neighbors yard. Who requests to change the landscape from pine straw to rock? The owner or the person who's back yard it is.

I'm a little confused. But, if you are talking about your back yard where your lanai is located, then you have control of the entire yard inside the fence. You also have sprinkler heads located in that area that are connected to your water system, and you are required to maintain them. You also have control of the area across from your front door that abuts to your neighbor's house, and outside of your neighbor's gate. You have one sprinkler head located in that area that is connected to your water system. This is all explained in great detail in your covenant document. The situation is somewhat unique because you actually have access and control of property that you do not own, because the property line is located midway between the houses. It is not "lot line" construction like some people are familiar with, where the property line runs directly adjacent to the house.

If you have a CYV, and your neighbor is a snowbird, you need to make sure that their sprinkler system is not spraying water under the eves of your house. There have been several instances where houses have been flooded by a broken sprinkler head spraying water under the eve and into the house. There are several sprinkler heads located directly under your eves and are connected to the neighbor's water system.

The person who's back yard it is, even though it is technically you property. That being said, it is in the back yard, unless Community Standards is invited into the back yard there is nothing that they can say or do, they can't peak over the fence.
