Default Driveway Disaster

The VCDD Utilities Water Dept found a leaky pipe under my driveway. The pipe in question was not connected to my house. They cut 2 big holes in my driveway and fixed the leak. The following week they poured concrete into the holes did a messy job. I called VCDD to find out when they would repaint the patches to match the driveway. VCDD informed me they are not responsible for repainting the driveway. They tore it up and should repaint it. Has any one else had this problem?

Call warranty. I bet things will be fixed.

It's probably within the right of way. Not their responsibility.

Had similar problem with damage caused to driveway by construction vehicles. Warranty fixed the concrete...but would not pay for the repainting of the driveway. Frankly, it stinks...

That is a slippery slope. We had a crack to the fringe of our driveway and warranty fixed it straightaway, replaced the section and did a good job....however we didn't have it painted aftermarket.

If I were the warranty department, and trying to do the right thing, I would not be an expert in all the finishes applied in driveway painting. Which means I would have to pay the driveway painters who would probably goudge in a situation like that.

I can see both sides.

You could repair it and send them the bill. If they do not pay go to small claims court.

Something to think about. You void your warranty to anything you change on it aftermarket. Never thought about this on driveways, but of course they fix the holes.

But if you have a different themostat put in your HVAC system, then you void the warranty. If you have your tiles sealed, you void the warranty.

That given, they have been WONDERFUL. Our first year was up Sept. 21.

Before you get lawyered up, check their obligation to restore within the right of way ( which extends about 10' beyond the curb).

Contact the POA, they will give you excellent advice. Or better yet, to to their meeting tomorrow night at Laurel Manor and ask J. Tutt your question directly, bring pictures.

Default Painted Driveway Water Leak

Sounds like all you might have is a prayer to get this fixed unless you are willing to pursue a legal route. Curious: How old is your home? Sometimes "things" just don't seem fair but life is so short it is also sometimes best to just move on. Wish I could offer better advise but in this instance can't! I'm asking approx. age of your home to get an idea on how well the infrastructure might hold up. Of course, this could just be a "freak" one time thing.

I think they are only responsible to restore it to the condition it was when you bought it. Unpainted concrete.
