Florida clarified their sales tax law to get inline with the rest of the states requiring online merchants doing more than $100,000 per year in business to pay FL sales tax. EBAY is collecting the tax that is required. Since the EBAY fee is part of the price of the item, sales tax applies to the EBAY fee. I do not view this as a new tax. This is colleting tax that is in reality rightly owed to the state of FL.

I’m pretty sure the collection of state and local sales taxes is the result of a federal law requiring online merchants to collect state taxes and local taxes, then distribute those collections to the state or locality where the purchase was shipped.

It is a florida law The link also shows which Senators voted yes or no. All our local representatives voted yes

No kidding. My post was in response to someone who felt that sales tax for items purchased on E-Bay should apply only to new items, not used items, and stated that was "fair". I was replying with an example of routinely taxed used items from a brick and mortar store to show that taxing used items on E-Bay would be just as "fair". Sorry if my meaning was too obscure.
