With all respect, Carl, whom I adore, it actually is your lawn for all purposes except as specified in the easement, which for the county is to build a road or the developer for utility repairs or upgrades. Otherwise homeless people could camp on my 13 foot easement.

In some cases, it may be an easement, which the homeowner owns. But in most cases, the area immediately adjacent to the road is right-of-way, which the homeowner does not own.

I'm not saying it's right to let your dog do his business there, because the homeowner does maintain it and it is for all intents and purposes part of the home's front yard. It should be treated as such IMHO.

We have a corner lot. Our dog is contained within our property by an Invisible Fence, so he does all his business in our yard. Our neighborhood has many other dogs and almost all their owners pick up if their dogs uses the grass in the easement closest to the street. Every once I awhile a stranger walks a dog and doesn't pick up after the dog. (That does frost me somewhat.) having said that, despite the use of a portion of our lawn by dogs, there is not a single spot where the lawn has suffered.
