Default Whoopee! Cart Liability Insurance

If you ever rent your home and would like to provide a golf cart for your guests, you probably know that presently, no insurance company will provide liability coverage to protect you if you rent the cart.

That is still true. However, last Friday one well known company changed (or maybe clarified is the better word), their policies in this area to allow you to "give permission" to someone to use your cart, even if they are renting your home. If you do not directly charge a fee for the use of the cart and have a statement somewhere that you gave permission for it's use, both you AND the renter will be fully covered by the policy. Four local agents had to make a special appeal to the company's home office to get this interpretation approved. The policy is their standard one, and there will be no surcharges for this new 'extension' of coverage.

I don't want this thread to be removed because it is construed as advertising for a specific company. Send me a PM and I'll give you the details and a contact person who was involved in the meetings about making this change.

I know the company, (begins with an A) know what the policy states, and I bet your attorney will tell you to run away from this. I checked this out about a month ago and they were saying the same thing about the so called "permission" loop hole. If it's a different company, PM me the name and I will dig into it more.

I was told by the company rep that the 'home office' gave specific approval of this change last Friday. I am awaiting review of the exact policy wording, but I was impressed by how detailed and emphatic the rep was describing the change.

You are walking a very fine line here. Unless I had the letter from the company, not the broker, nailed on my garage wall, I would not even think of letting the car go with the rental Regardless of any paper that is signed, both you and the insurance company are going to know that the actual fact of the matter is, the cart is rented. I would be terrified if a major crash occured with a tenant driving the cart. Be very carefull how you word the letter. Personally, I would not do it.

Just get it in writing about the change.Cart will be covered for renters driving. Would not worry.

I questioned my attorney and my insurance man about renting, loaning or whatever you want to call it, my cart with the house and they both gave me a big fat NO. My attorney said that if you have a $1,000,000 rider on your policy and a person damaged or hurt by your cart needed 24 hour care for years, you could eat up that million very quickly. Because my property is a non homesteaded property, I could lose it and it's contents in a civil suit. WHY, I repeat WHY would you ever want to put yourself in that situation? As for my insurance agent, he repeated my attorney's advice. I rent my property during the peak season only and my renters have no problem renting some wheels on their own.---That's my story and I am sticking to it!

I am in agreement with those who caution renters and cart owners to be very careful on this matter. Regardless of what the agent or broker says, the terms of the policy will prevail.
You will probably find a section of your policy dedicated to misrepresentation and fraud. Read it carefully. If you do not understand it, seek legal advice. I mean an attorney not an agent or broker.
One may be very sure they are on safe ground but when there is an accident and the insurance company examines the facts, and they will, one may find themselves in big trouble.
Loaning a cart to a renter is not the same as loaning it to your neighbor while his in the shop or to a visitor who is your guest for a few days.
A cart accident can result in big bucks in damages. Insurance companies do not arbitrarily pay out big bucks without a thorough examination of the facts.

Be extremely careful! You might be getting some bogus misinformation from a company that could be very costly. I would go along with the posters in #12 and #13 and advise talking to an attorney instead of an insurance agent.

You do not want to lose all you have worked for all your life for the purpose of including a cart in with a home rental. It ain't worth it!!
