Apparently someone wants to know the names of those who sued TV about injury from the buffalo so that they can start a class action lawsuit against those injured by the buffalo and suing TV for lessening the value of their property. Having worked with attorneys almost my entire adult life, it took everything I had to not burst out laughing. I have no doubt some attorney will happily take their money. However, there is some reality and facts people need to face -- the buffalo have injured people over a span of years. There is no question that the developers and managers of TV were aware of at least some of these injuries. Thus, there is knowledge that (1) the buffaloes attract people and (2) that people have been hurt by the buffalo because of the idiot actions of those people. This is what is at the very heart of "attractive nuisance" lawsuits. The injured had a right to sue. The developer ultimately has an obligation to protect people from their own stupidity (what a sad statement that is). The ones harmed are those who do respect the buffalo as the magnificent animals they are. We lose. The stupid ones (and their attorneys) win. I honestly can't imagine a judge letting a class action suit go forward against those injured.

Those who are attorneys or who have studied the law, what do you think -- does such a class action suit have even a buffalo horn to stand on?

You have got to be kidding. The judge would be laughing on the inside and probably on the outside as she heard this class lawsuit against those who were injured by the buffalo. I am sure that you could get an attorney to take this lawsuit against the injured by the buffalo though.

Tal can a lawsuit be brought against people who do not follow regulations and thus infringe on the rights of others?

I do know laws are quite interesting - if a burglar is robbing your home and in the process injures himself I have heard he can sue you.

The question is always whether there is a reasonable expectation of care and protection against a known or perceived hazard. As an example - fencing is required (a certain height and type) around a swimming pool specifically because of a pool being considered a known hazard. So, does the landowner have a "duty of care" in this regard, was the "duty" breached by neglect or insufficiency in any manner, and lastly, what "damages" were indeed incurred?

As far as the suggested class action suit, my guess is that would probably hinge on whether the homeowners' deeds (including covenants and restrictions) have a "buffalo" provision. If they don't, then (pardon the pun) the "chips" have already fallen......

Sure that sounds like a likely scenario for a lawsuit like when some tourists feed a gator and the gator then takes a chunk out of a park employee. The park employee would have a good lawsuit IMHO.

Not sure if that is the case with grandkids and grandparents feeding the buffalo as they are not even trespassers unless they climb over the fence (or even fences) and then do this.

Actually this animal is not a Villages Buffalo. I took this picture in my back yard. We have a horse ranch and Buffalo ranch at our back fence in Chatham. This guy was looking at me over my back fence.

Hey Jan, if you could arrange to get bitten or maybe even scared a bit, you could sue the owner of the ranch for a few mil. After lawyer fees, you still probably have enough to buy a place in one of the Bridgeports and get away from the train.
