Just wondering about this. If we agreed to covenants when we bought our homes, do the agreements between developer and residents continue if the developer sells his interest in the service to another organization that was not a party to the original agreement?
If homeowner agreed to pay the developer for pick up of trash and recyclables and the developer sells his interest to another new company, do these original covenants continue? |

It probbly will take a (retired) lawyer to answer factually. Logic tells me the new 'developer' would have to honor to covenants as would the landowner. If you sell a house that you have leased or rented to someone else, and the term of that lease in not over before the sale is completed, the new owner has to honor the existing lease. Of course, leases expire whereas convenants do not so there is the rub.

I believe the rule of thumb is that the covenants go with the land.
