Default Computer RipOff

Recently "traded" my small (relatively new) working computer to a computer shop in Marion Flea Mkt + $150 for a Laptop that he told me worked perfectly. I bought it in Saturday and after finding out it did not work correctly ( I have been into computer 27 years) I tried to take it back (today) 6 days later and get a refund. He was very upset that I wanted a refund and said that since he did not know Windows 8 didn't know if it worked ok or not and he "Gave Away" my computer that I traded and therefore refused a refund.

Is there any "recourse" I can take? Small claims court? It's just $300 but I hate having a computer that will not work and feel I got ripped off.

Thanks as I have contacted the Mgr at Marion Flea Mkt but there's nothing he can do. You would think a Computer Repair & Sales person (Herb Olmstead / "Computers & Laptops Sales & Repairs) would at least know what he sells.

if you have used computers for 27 years you would think you should have known better than to buy one at a flea market and expect perfect results. Buyer Beware!!!!

I guess you didn't plug it in and try it first?

You know computers-you never plugged it in to see if it works-AND you did this at the Flea Market!! Is there something wrong with this program????

So what some are saying is just cause you are a vendor at the Market of Marion you are not reputable. Of course, if same vendor was on The Squares on Market nights they would be considered 5 star rated in reputation and honesty. I know in fact that would be inaccurate.

If nothing else, there's small claims court. The seller did say it worked, so you should have an implied warranty. The fact he gave away your computer is irrelevant. The fact it was purchased at a flea market is irrelevant. This is not someone whose only business is selling stuff, this is someone who claims to have a business buying, selling and repairing computers. Hope you get a satisfactory resolution.

Excellent response, Redwitch. I think that is what the OP is looking for here on this forum. OP was certainly not looking for some of the smart alec/rude put downs posted.
