If a deed restriction is not enforced it doesn't go away. Read the hearing on window air conditioners on the historic side. VCCDD June 2011
Case No. LL-11-11 Richard and Patricia O'Connor, 1416 Bonaventure lane, Unit 9, Lot 2705 A. Staff Overview and Recommendation Ms. Tucker advised Case No. LL-11-11, Village Center Community Development District vs. Richard and Patricia O'Connor, Unit 7, Lot 2705 is in violation of the District's Rule to Bring About Deed Compliance and specifically the Rule that states, “Window air-conditioners are strictly prohibited Read your deed. Don't do anything that may place you in violation of deed compliance without a plan to undo the change. The deed compliance folks do not want to go to a hearing. A simple oh I'll fix it come back in 2 weeks will work in most cases. |

And when they come back and check it in two weeks and you have not fixed it, you can be pretty sure you will get a registered letter stating your courses of action. After that you will be subject to fines.

Why do some always feel, rules don't apply to me?

If that were not the case, there would be a long line of people in the "rules don't apply to me" line.

Bogie...this has had me puzzled as well! Guess it's the "Entitlement" mentality!

One of the major problems with deed restrictions is the fact that if they 'let something go'...suddenly they have set a precedent and therefore EVERYONE is entitled to do the same thing. If the offense is not dealt with it causes way more problems. Personally, I am glad that the restrictions are enforced, it makes decisions so much easier. We have had cases here in Michigan (and I'm sure elsewhere)...subdivisions that don't allow fences...somehow one person managed to get a fence up without anyone complaining (usually by putting up an above ground pool that requires fencing...then removing the pool)...now the next person says "they have a fence...so can I" and there goes the restriction. Kinda sounds like fourth grade, doesn't it? but unfortunately, that's the way the law is interpreted. Know something?? I don't care about air conditioners, fences or yard ornaments, I just want to get there!!!! Today I had to put away my sandals
