Around 1100 this morning my guest was parked in front of my house & a neighbor backed into the bumper causing some damage....
The first thing she said.... "you cannot park on the street!" and continued on to the market....
When we called it in, the sheriff told her that the neighbor would get a ticket because she crossed over to the far side of the road.
(then... he whispered, "You really can't park on the road because it is a County Road!)

HELP!!!

My thoughts are if it were illegal to park on a road then signs would or should be up to say so.!

I would prefer not to have streets littered with signs every 50 feet explaining the obvious.

i am afraid I will not help find the answer, but I am killing time by the computer and wanted to boost my post count.

When I see threads like these two, I get a kick out of the fact that a person gets in their car, backs out and hits a stationary object that has been there and not moved since before they started backing out.

They then draw the conclusion the blame lies with the person who put the STATIONARY object there

I do not care if you park in my driveway right in front of my garage blocking my exit. If I hit your car I do not see how it is not my fault. I doubt I would get out and yell who put that giant object right in my way....

I always wonder what their reaction would have been if it was a person and not a car?

Nobody said anything about yelling at somebody, but if it's in Sumter county, it is against the law.
These streets are not wide enough for street parking, that's why there are no lines designating parking places.
Law or no law, it's just a matter of courtesy.
Gomoho summed it up nicely in another thread: "It's the same as the dog poop, retrieving golf balls, and a host of other issues we seem to suffer - people not being courteous or conscious of other people feelings or space. An age old problem humanity will probably always be plagued by that could simply be solved by using plain old common sense."

In Marion County it is an everyday occurrence vehicles parking on the street. Unless they are there 24/7 I don't see a problem, we can or shouldn't speed down the streets so just go slow and go around the parked vehicle no big deal. So I guess In Sumter County if you have a bunch of people over and they all may not use or have golf carts where do they park on the lawn? Just wondering.... I have no problem with street signs but then that would require people to read....

How would lawn mowing trucks and trailers, the bug killer man, yard spray man, driveway painter man, aluminum siding guy and roofer guy fit into the no parking in the street thinking?

I guess you could call Sumter county and ask, but most assume it's a common sense thing. Some have it, some don't. Just like common courtesy.

actually you can park on the street but not overnight. Temp. parking is allowed. So workmen visitors etc can park there for a time. That is the actually law that applies.
Since the woman hit your car she is responsible for any damage to it. No matter what she says. Same thing for those golfers who think that when they hit a ball and damage someones home they don't have to pay for the damages.
If you want too follow it up notify your car insurance company. I would however tell the person who hit your car that you are doing it. Because she will indeed get hit with a charge from her insurance company her rates go up. etc..

Why can't people just back into their driveway when parking? I always do.

We live in a neighbourhood up north with lots of kids and it is much easier and safer for the kids for us to back into the driveway and drive out forwards.

You can see what's there when you back in and you darned well can see what's in front of you when you drive out.

I've never had a problem backing out of our driveway even with a lawn maintenance trailer in the street. Striking a stationary object means unassured clear distance to me.

The person backing out of the driveway is at fault regardless of the legality of parking in that spot. If a child was standing there illegally does that give you the right to hit them? No. A person backing has a greater duty of care.

I would let them know you plan to submit it to your insurance company and she will be the at fault party (unless she can show that your friend slammed the side of her car into the neighbors rear bumper ). That will give her the opportunity to pay it out of pocket if she so chooses, in order to avoid a possible surcharge against her policy.
