Well, since we're birthday twins and I absolutely, positively adore cherry pie (my true favorite), let it be known that not only do I abhor the drinking of alcohol beverages, but I would be much happier if all alcohol was banned from the squares. In the place of alcohol, I vote smoking be allowed in all areas. So, when do I get my pie?

If it's illegal to serve alcohol from a business (other than the kiosks) and walk off their premises with it, then we should call the police department the next time they hold a Wine Walk to raise funds for the Moffit Center because not only did people walk off those premises and into the streets with wine, some of those businesses didn't even have a liquor license. One in particular had an under age student pouring wine that night. How did they get away with that for four hours with UNLIMITED pours?

BTW the wet zone limit is Avenida Central/US27-441 for SPSPR; and Old Camp Rd./Lake Shore Drive for LSL.

In NY you can be under 21 to serve liquor. Not sure about Florida.

How about the people doing the wine and cheese in Sunset Park every evening. Violation of "open container law", or not?

I guess if they are sitting in the cart, yes. If they are sitting in chairs, who knows? You find find me testing it out.

Default Not Clear

As I said before, if that is the law then it's the law. What I do take issue with is the out-of-the blue enforcement of that law.

We moved here 8 years ago (will be come Feb.). Until now, this is the first I have heard of anyone being ticketed for something that has been going on for that long. I am only questioning why the sudden enforcement now? Did they get complaints from the tee-totalers or something?

It seems from what I'm reading here, lots of people feel that they have been blindsided....it was ok yesterday, but oops, not today? We don't go to the squares that often and when we do we don't go to sit in the cart and drink or anything else. We drive there, get out, and get in again to come home so getting "caught" is not an issue for us. For the most part, we choose not to drink there because it's too expensive....lot cheaper at home. Have we had a drink there? Yes, but not often and certainly not many.

You all have to understand, if its in the best interest of the Villages its OK, if it isn't is Not, you all have to live with this rule, I have live here for 16 years and I have seen this over and over again.

“I have seen this over and over again.” Are you speaking of the new rules in general or getting busted for drinking in a golf cart? The reason I ask is a Village rule and a state law are two different animals but then we all know that.

So you think the Villages should not look after their best interests? Don't most people? Really.

I think if it is "out of the blue" enforcement, then it is a legitimate concern, BUT, we don't know if this is a recent development or not:

1. Not everybody who lives in TV is on TOTV, so we might not hear about other instances of enforcement that have occured in the past. There might be lots of others out there who have been ticketed over the years but we just haven't heard about it. This could certainly make it seem like "out of the blue" enforcement.

2. There is not really a heavy police presence in the squares, the few officers they have are spread pretty thin, so I imagine that drinking while seated in the carts has gone on for a while without the few officers that are around seeing it. Once they do, they write the tickets. This also could certainly make it seem like "out of the blue" enforcement.

The recent ticketing incident for enjoying a cocktail while sitting in a golf cart in Lake Sumter Landing was the first item addressed by Janet Tutt at last evening's POA meeting. Janet said expect to see heightened enforcement of the open container law throughout The Villages, including tail-gate parties at the Polo Field. She went on to explain that the liquor licenses for the kiosk's in the squares allow people to walk throughout the downtown area (outside the square) with a drink but you cannot sit in a vehicle, including a lawn mower, with a drink. She also said police would enforce the open container violations (but not speed enforcement) on The Villages multi-modal paths. Janet also said liquor licenses for the restaurants in the Square, unlike the kiosks, do not permit patrons to leave the establishment with a drink. If the beverage is in a cup holder, the person in the driver's seat is ticketed unless the passenger is holding the cup. The fine is $116, if I remember correctly. Getting back to the Polo field, she suggested setting up a chair or table next to the golf cart and mixing the drinks there rather than on the golf cart. Seems like a crazy distinction but that's the law here now.

Bummer, with my withering memory this is one more thing to write on the palm of my hand along with keep your head down and slow back swing.

Let's see.... OK to stand or sit next to the cart, but better not sit in cart. OK to party hardy from a table but don't try to pull that drink out of the trunk of your car? Did they cover how to get the bottles to and from the game? Whew... I think my head is spinning now!
